2. Objet

Les présentes Conditions Générales de Vente (CGV) définissent les droits et obligations des parties dans le cadre de la vente en ligne de bijoux artisanaux (boucles d’oreilles en polymère) proposés par TOTOU jewelry via son site internet.

3. Produits

Les produits sont décrits avec la plus grande exactitude possible (photos, dimensions, matériaux).
Étant de fabrication artisanale, de légères variations de couleur, de forme ou de finition peuvent exister et ne sauraient être considérées comme des défauts.

4. Prix

Les prix sont indiqués en euros, nets de TVA (« TVA non applicable – art. 56bis Code TVA »).
Les frais de livraison sont précisés séparément avant validation de la commande.

5. Commande

La commande est validée après confirmation du paiement.
TOTOU jewelry se réserve le droit de refuser toute commande en cas de rupture de stock, d’erreur manifeste sur le prix, ou de suspicion de fraude.

6. Paiement

Le paiement est exigible immédiatement à la commande.
Moyens acceptés : carte bancaire (Visa, Mastercard, etc.) et PayPal.
Les transactions sont sécurisées par des prestataires externes.

7. Livraison

• Fréquence d’expédition. Les commandes sont préparées artisanalement et expédiées au minimum une fois par semaine. Selon la charge et les périodes, des expéditions supplémentaires peuvent être réalisées.

• Choix du point relais. La livraison est assurée par Mondial Relay, en point relais. Après validation et paiement, le client sélectionne sur le site le point relais de son choix.

• Pays desservis actuellement : Belgique, Luxembourg, Pays-Bas, France, Allemagne, Espagne, Portugal, Italie, Pologne et Autriche.

Conformément à l’article VI.43 du Code de droit économique, la livraison interviendra en tout état de cause au plus tard dans les 30 jours suivant la confirmation de la commande.

8. Droit de rétractation et retours

Pour des raisons d’hygiène et de protection de la santé, les boucles d’oreilles (y compris modèles clips) ne peuvent être retournées si l’emballage scellé a été ouvert.

Seuls les retours liés à une erreur de livraison ou à un défaut manifeste constaté dès la réception sont acceptés.
Dans ce cas, le client doit notifier le problème par écrit à jewelry.totou@gmail.com dans un délai de 7 jours maximum après réception, photos à l’appui.

Aucun retour ne sera accepté si le produit a été porté ou manipulé.
Les frais de retour sont à la charge du client.
Le remboursement (produit + frais de livraison initiaux) interviendra dans les 14 jours suivant la réception du retour accepté.

9. Garanties légales

Conformément au droit belge et européen, le client bénéficie d’une garantie légale de 2 ans, applicable uniquement en cas de défaut de fabrication existant au moment de la livraison.

⚠️ Pour des raisons d’hygiène et de sécurité liées aux bijoux, cette garantie est strictement limitée aux défauts visibles et signalés immédiatement après réception (ex. article cassé, élément manquant, mauvaise référence envoyée).

Passé un délai de 7 jours après réception, le produit est réputé conforme et aucune réclamation ne sera acceptée.

10. Responsabilité

TOTOU jewelry ne saurait être tenue responsable dans les cas suivants :

• utilisation non conforme ou abusive des bijoux,

• dommages résultant d’un accident ou d’un défaut d’entretien,

• réactions allergiques si la composition a été communiquée clairement,

• retards, pertes ou dommages imputables au transporteur,

• fausse déclaration ou tentative frauduleuse du client.

En cas de mauvaise foi manifeste (ex. retour d’un produit porté ou volontairement endommagé), TOTOU jewelry se réserve le droit de refuser le remboursement et de conserver le produit retourné.

La responsabilité de TOTOU jewelry est dans tous les cas limitée au montant de la commande concernée, sauf faute grave ou intentionnelle.
Les garanties légales de conformité et contre les vices cachés demeurent applicables.

11. Données personnelles

Les données collectées sont nécessaires au traitement et à la livraison des commandes.
Elles sont traitées conformément au RGPD (UE 2016/679).

2. Purpose

These General Terms and Conditions of Sale (T&Cs) define the rights and obligations of the parties in the context of the online sale of handcrafted jewelry (polymer clay earrings) offered by TOTOU jewelry via its website.

3. Products

The products are described as accurately as possible (photos, dimensions, materials).
As they are handcrafted, slight variations in color, shape or finish may exist and shall not be considered defects.

4. Prices

Prices are indicated in euros, net of VAT (“VAT not applicable – Article 56bis VAT Code”).
Delivery costs are specified separately before order confirmation.

5. Orders

An order is confirmed only after payment has been validated.
TOTOU jewelry reserves the right to refuse any order in the event of out of stock, obvious pricing error, or suspected fraud.

6. Payment

Payment is due immediately upon order confirmation.
Accepted methods: credit/debit card (Visa, Mastercard, etc.) and PayPal.
Transactions are secured by external service providers.

7. Delivery

• Shipping frequency. Orders are handcrafted and shipped at least once per week. Depending on workload and periods, additional shipments may be arranged.

• Relay point selection. Delivery is handled by Mondial Relay, to a relay point. After payment validation, the customer selects the relay point of their choice directly on the website.

• Countries currently served: Belgium, Luxembourg, Netherlands, France, Germany, Spain, Portugal, Italy, Poland, and Austria.

• Delivery fees:

• Indicative delivery times (after shipment):

In accordance with Article VI.43 of the Belgian Code of Economic Law, delivery shall in any case take place within a maximum of 30 days following order confirmation.

8. Right of Withdrawal and Returns

For hygiene and health protection reasons, earrings (including clip-on models) cannot be returned if the sealed packaging has been opened.

Returns are only accepted in the event of a delivery error or an obvious defect noticed upon receipt.
In such cases, the customer must notify the issue in writing to jewelry.totou@gmail.com within 7 days of receipt, including photos as proof.

No return will be accepted if the product has been worn or handled.
Return shipping costs are the responsibility of the customer.
Refunds (product + initial delivery costs) will be processed within 14 days of receipt of the accepted return.

9. Legal Warranty

In accordance with Belgian and European law, the customer benefits from a 2-year legal warranty, applicable only in cases of manufacturing defects existing at the time of delivery.

⚠️ For hygiene and safety reasons specific to jewelry, this warranty is strictly limited to visible defects reported immediately upon receipt (e.g., broken item, missing component, wrong product delivered).

After 7 days from receipt, the product is deemed compliant and no claims will be accepted.

10. Liability

TOTOU jewelry shall not be held liable in the following cases:

• improper or abusive use of the jewelry,

• damage resulting from an accident or poor maintenance,

• allergic reactions if the composition was clearly communicated,

• delays, losses, or damage attributable to the carrier,

• false declaration or fraudulent attempt by the customer.

In cases of obvious bad faith (e.g., return of a worn or deliberately damaged product), TOTOU jewelry reserves the right to refuse a refund and retain the returned product.

TOTOU jewelry’s liability is in all cases limited to the amount of the order concerned, except in cases of gross negligence or willful misconduct.
The legal warranties of conformity and against hidden defects remain fully applicable.

11. Personal Data

The data collected is necessary for processing and delivering orders.
It is processed in compliance with the GDPR (EU 2016/679).
The customer has the right to access, rectify or delete their data by contacting: jewelry.totou@gmail.com.

12. Intellectual Property

All creations, photos, and texts on the website https://www.totoujewelry.com/ are protected by copyright and remain the exclusive property of TOTOU jewelry.
Any reproduction is prohibited without prior authorization.

13. Governing Law and Disputes

These Terms and Conditions are subject to Belgian law.
In the event of a dispute, an amicable solution will be sought.
The customer may contact the Consumer Mediation Service free of charge (www.mediationconsommateur.be).
Failing agreement, the courts of the consumer’s place of residence shall have jurisdiction.

2. Doel

Deze Algemene Verkoopsvoorwaarden (AV) bepalen de rechten en verplichtingen van de partijen in het kader van de online verkoop van handgemaakte juwelen (oorbellen van polymeer) die door TOTOU jewelry via haar website worden aangeboden.

3. Producten

De producten worden zo nauwkeurig mogelijk beschreven (foto’s, afmetingen, materialen).
Aangezien het om handgemaakte artikelen gaat, kunnen lichte variaties in kleur, vorm of afwerking voorkomen en worden deze niet als gebreken beschouwd.

4. Prijzen

De prijzen worden vermeld in euro, exclusief BTW (“BTW niet van toepassing – art. 56bis BTW-Wetboek”).
De verzendkosten worden afzonderlijk gespecificeerd vóór de bevestiging van de bestelling.

5. Bestelling

Een bestelling is pas definitief na bevestiging van de betaling.
TOTOU jewelry behoudt zich het recht voor om een bestelling te weigeren in geval van voorraadtekort, een duidelijke prijsfout of vermoedelijke fraude.

6. Betaling

De betaling is onmiddellijk verschuldigd bij de bestelling.
Aanvaarde betaalmethoden: bankkaart (Visa, Mastercard, enz.) en PayPal.
Transacties worden beveiligd via externe betalingsverwerkers.

7. Levering

• Verzendfrequentie. Bestellingen worden ambachtelijk voorbereid en minstens één keer per week verzonden. Afhankelijk van de werkdruk en periode kunnen extra verzendingen plaatsvinden.

• Keuze van afhaalpunt. De levering gebeurt via Mondial Relay, in een afhaalpunt. Na bevestiging van de betaling kiest de klant op de website het afhaalpunt van zijn/haar keuze.

• Landen die momenteel bediend worden: België, Luxemburg, Nederland, Frankrijk, Duitsland, Spanje, Portugal, Italië, Polen en Oostenrijk.

• Verzendkosten:

Overeenkomstig artikel VI.43 van het Wetboek van economisch recht vindt de levering in ieder geval plaats binnen maximaal 30 dagen na bevestiging van de bestelling.

8. Herroepingsrecht en retourzendingen

Om redenen van hygiëne en gezondheidsbescherming kunnen oorbellen (ook clipmodellen) niet worden geretourneerd indien de verzegelde verpakking is geopend.

Retourzendingen worden alleen aanvaard in geval van een leveringsfout of een duidelijk gebrek dat onmiddellijk bij ontvangst wordt vastgesteld.
In dat geval moet de klant het probleem schriftelijk melden aan jewelry.totou@gmail.com binnen 7 dagen na ontvangst, met foto’s ter ondersteuning.

Geen enkele retourzending wordt aanvaard indien het product gedragen of gemanipuleerd is.
De retourkosten zijn ten laste van de klant.
De terugbetaling (product + initiële verzendkosten) gebeurt binnen 14 dagen na ontvangst van de aanvaarde retour.

9. Wettelijke garanties

Overeenkomstig de Belgische en Europese wetgeving geniet de klant een wettelijke garantie van 2 jaar, enkel van toepassing in geval van een fabricagefout die reeds bij levering aanwezig was.

⚠️ Om hygiënische en veiligheidsredenen die specifiek zijn voor juwelen, is deze garantie strikt beperkt tot zichtbare gebreken die onmiddellijk bij ontvangst worden gemeld (bijv. gebroken artikel, ontbrekend onderdeel, verkeerd geleverd product).

Na een termijn van 7 dagen na ontvangst wordt het product geacht conform te zijn en worden geen klachten meer aanvaard.

10. Aansprakelijkheid

TOTOU jewelry kan niet aansprakelijk worden gesteld in de volgende gevallen:

• onoordeelkundig of misbruik van de juwelen,

• schade als gevolg van een ongeval of slecht onderhoud,

• allergische reacties indien de samenstelling duidelijk werd meegedeeld,

• vertragingen, verliezen of schade die te wijten zijn aan de vervoerder,

• valse verklaringen of frauduleuze pogingen van de klant.

In geval van duidelijke kwade trouw (bijv. retour van een gedragen of opzettelijk beschadigd product) behoudt TOTOU jewelry zich het recht voor om de terugbetaling te weigeren en het geretourneerde product te behouden.

De aansprakelijkheid van TOTOU jewelry is in alle gevallen beperkt tot het bedrag van de betrokken bestelling, behalve in geval van zware fout of opzettelijke nalatigheid.
De wettelijke garanties van conformiteit en tegen verborgen gebreken blijven volledig van toepassing.

11. Persoonsgegevens

De verzamelde gegevens zijn noodzakelijk voor de verwerking en levering van bestellingen.
Ze worden verwerkt in overeenstemming met de GDPR (EU 2016/679).
De klant heeft het recht op inzage, correctie en verwijdering van zijn/haar gegevens door contact op te nemen met: jewelry.totou@gmail.com.

12. Intellectuele eigendom

Alle creaties, foto’s en teksten op de website https://www.totoujewelry.com/ zijn auteursrechtelijk beschermd en blijven het exclusieve eigendom van TOTOU jewelry.
Elke reproductie is verboden zonder voorafgaande toestemming.

13. Toepasselijk recht en geschillen

Deze AV zijn onderworpen aan het Belgisch recht.
In geval van een geschil zal naar een minnelijke oplossing worden gezocht.
De klant kan gratis een beroep doen op de Consumentenombudsdienst (www.mediationconsommateur.be).
Bij gebrek aan akkoord zijn de rechtbanken van de woonplaats van de consument bevoegd.

14. Aanvaarding van de AV

De bevestiging van een bestelling impliceert de volledige en onvoorwaardelijke aanvaarding van deze Algemene Verkoopsvoorwaarden.
